Delhi HC refuses to extend Kuldeep Singh Sengar’s interim bail in Unnao rape cases

New Delhi: The Delhi High Court on Monday (January 20) refused to extend the interim bail granted to expelled Bharatiya Janata Party (BJP) leader Kuldeep Singh Sengar in the main Unnao rape case and connected case of custodial death of the Unnao rape victim’s father.

A division bench comprising Justice Navin Chawla and Justice Shalinder Kaur, while noting that Sengar’s application seeking extension was not supplied to the survivor, refused to grant him relief.

“Take him into custody. This application has not been served,” the bench said.

Another division bench directed Sengar to surrender on January 20

Another division bench last week, while recusing itself from hearing Sengar’s plea for extension of the interim bail period, refused to extend Sengar’s plea seeking extension of his interim bail and directed him to surrender on January 20 as earlier directed.

Single bench also refused to extend Sengar’s interim bail in connected case

A single bench of Justice Vikas Mahajan, while observing that in view of the stand taken by the division bench declining the interim bail, said that extending Sengar’s interim bail in the custodial death of the Unnao rape victim’s father would serve no purpose.

“If the division bench has refused, it would not serve any purpose. You surrender,” Justice Mahajan said.

The senior counsel representing Sengar told Justice Mahajan that he would surrender before the authorities today evening.

“Today, he is surrendering at 5:30 (pm),” Sengar’s counsel said, news agency PTI reported.

Sengar is serving sentence in Unnao main rape case, connected case

While Sengar is serving life imprisonment for the remainder of his biological life in the main Unnao rape case for allegedly kidnapping and raping the minor in 2017, he is serving a 10-year jail-term awarded to him in the case of the death of the father of the Unnao rape victim in custody.

High Court granted interim bail to Sengar in December last year

The High Court granted Sengar a two-week interim bail in early December last year on account of his health in the main Unnao rape case and it was subsequently extended by another month. He was also granted relief in the connected case.

The Unnao main rape case and related cases were transferred on the orders of the Supreme Court from the trial court in Uttar Pradesh to Delhi on August 1, 2019.
