New Delhi: A city court on Tuesday (May 27) denied bail to former Aam Aadmi Party (AAP) MLA Naresh Balyan in a case registered under the stringent sections of the Maharashtra Control of Organised Crime Act (MCOCA).

Special Judge Dig Vijay Singh dismissed Balyan’s bail application, saying there was no sufficient ground to grant him bail in the case.

Balyan, whose first bail application was previously also dismissed, was produced before the court through video conferencing from jail, news agency PTI reported.

Delhi Police opposed Balyan’s plea for bail

The Delhi Police opposed Balyan’s plea for bail, arguing the investigation into the matter was at crucial stage and if he is granted bail, he would hamper the probe.

The Delhi Police filed the chargesheeted against Balyan in the case on May 1.

The supplementary chargesheet was filed in the case against four accused persons – Sahil alias Poli, Vijay alias Kalu, Jyoti Prakash alias Baba, and Balyan – under sections of the MCOCA.

All accused persons were arrested in the case, which relates to an organised crime syndicate allegedly run by gangster Kapil Sangwan alias Nandu.

Balyan was arrested in the case on December 4 last year

Balyan was arrested in the case on December 4 last year while he was in police custody in another case – an alleged extortion case. He was granted bail on December 4 in the extortion case.

Balyan was earlier denied bail in the MCOCA case on January 15

Balyan was denied bail earlier in the case registered under the stringent MCOCA provisions on January 15.

The Delhi Police, while opposing the bail application filed by Balyan and urging the court to dismiss the same, alleged before the trial court that Balyan was a facilitator in the organised crime syndicate. It had further argued before the court that Balyan, along with his absconding associates, were involved in the commission of organised crime, including extortion from businessmen.
