Bombay HC grants medical bail to Jet Airways founder Naresh Goyal in ED case

Mumbai: The Bombay High Court on Monday (November 11) granted bail to Jet Airways founder Naresh Goyal, who is an accused in a money laundering case and sought bail to undergo treatment for cancer, on medical grounds.

Goyal was earlier in May granted interim bail by the High Court on medical grounds for two months and later it was extended by the High Court.

The single bench of Justice Jamadar had granted Goyal interim bail for two months with the direction to pay a surety of Rs 1 lakh, not to leave Mumbai city without prior permission from the trial court and to abide by all the conditions imposed and surrender his passport.

Goyal moved High Court against trial court order

Goyal had moved the High Court against trial court’s order, which refused to grant him bail on medical grounds in February. The trial court, however, allowed him to be admitted in a private hospital and seek medical treatment. Goyal, in his plea before the High Court submitted that he and his wife Anita Goyal are suffering from cancer and sought interim bail on medical and humanitarian grounds.

The ED opposed Goyal’s plea for interim bail, submitting that he could be admitted to a hospital of his choice and take treatment there while in custody.

ED arrested Goyal in September last year

Goyal, who was arrested by the Enforcement Directorate (ED) in September 2023, is an accused in an alleged Rs 538 crore fraud at Canara Bank. It has been alleged that he had laundered money and siphoned off Rs 538.62 crore loans by the Canara Bank to Jet Airways.

Goyal’s wife died in May this year

Goyal’s wife was also arrested in the case in November 2023 when the chargesheet in the case was submitted by the ED. She was, however, granted bail by the trial court the same day taking into consideration her age and medical condition. She died on May 16, 2024.

What did Goyal earlier tell trial court?

Goyal had earlier told the trial court that his health is in very bad shape, he missed his bedridden wife, who was in the advanced stage of cancer, very badly and her only daughter is also not well and had requested the court with folded hands not to send him to JJ Hospital for medical check up and instead “allow him to die in the jail itself”.
