New Delhi: A city court on Friday (May 30) sentenced former Madhya Pradesh MLA Kishore Samrite to six-month imprisonment for sending a letter with a threat to blow up the Parliament in September 2022 if his demands were not met.

Special Judge Vikas Dhull sentenced the former MLA under section 506 Part II (threat to kill or grievously hurt) of Indian Penal Code (IPC).

Samrite threatened to blow up the Parliament of India with dynamite by sending a letter of threat (containing certain demands) and a suspicious substance to the Secretary General of the Rajya Sabha on September 16, 2022.

“Convict has been sentenced for the period of 6 months for the offence under section 506 (II) IPC with fine,” Special Judge Vikas Dhull said.

The judge, however, acquitted Samrite of the charge under Explosives Act, taking note that the substance in question did not constitute an “explosive” under the Act.

The court said that the substance in question does not constitute an “Explosive” under the Explosives Act or/and “Explosive Substance” under the Explosive Substances Act, the letter from Samrite, threatening to blow up the Parliament building, constitutes a threat to cause destruction of property be fire, thereby rendering him liable for conviction under Part II of section 506 of IPC.

The court earlier convicted Samrite, the former MLA from Lanji in Madhya Pradesh’s Balaghat district, for threatening to blow up Parliament. It had said that aside from a copy of the Constitution and the Indian flag, the articles sent by Samrite to the Rajya Sabha official contained a letter, a suspicious substance.

“The letter was explicit in expressing the intention to blow up the Parliament, using dynamite, on a specific date and time, i.e., 11 o’clock on September 30, 2022 if the demands expressed in the letter by the accused were not met,” the court had noted while convicting Samrite.
