New Delhi: The Delhi High Court on Monday (January 27) was informed that Kuldeep Singh Sengar, a convict in the Unnao rape and a related case, has returned back to Tihar Jail due to the unavailability of the surgeon who was supposed to perform his eye surgery.

Sengar was on January 22 granted interim bail on medical grounds by the High Court, which directed for his release from the jail on January 23 to undergo an eye surgery at AIIMS on following day and also asked him to surrender the same evening if the surgery could not take place.

Sengar returned to Tihar Jail on January 24 due to the unavailability of surgeon, counsel informed High Court

A bench comprising Justice Yashwant Varma and Justice Harish Vaidyanathan Shankar was informed by Sengar’s counsel that he surrendered and returned to Tihar Jail on January 24 due to the unavailability of a AIIMS surgeon, who was supposed to perform his cataract surgery, was not available till January 30. The counsel further told the bench that Sengar would approach the court again either on January 28 or 29 to seek interim bail on medical grounds for his cataract surgery.

Sengar, who is serving life imprisonment for the remainder of his biological life in the main Unnao rape case for allegedly kidnapping and raping a minor in 2017, has challenged the trial court order before the High Court.

Sengar is also serving 10-year jail term in a connected case

Sengar is also serving a 10-year jail term awarded to him by the trial court in the connected case of the death of the father of the Unnao rape victim in custody. He has also moved the High Court seeking suspension of his sentence in the case.

High Court on January 20 refused to extend Sengar’s plea for interim bail

The High Court earlier in December last year granted Sengar a two-week interim bail on medical grounds and it was subsequently extended by another month. The High Court, however, refused to extend his interim bail on January 20 and asked him to surrender, noting that the copy of his plea seeking extension of his interim bail was not supplied to the survivor. Later, it granted him interim bail on medical grounds on January 22.
