Dehradun: Electronical appliance giant LG has won a case in consumer court against a man who had sued the company alleging breach of an advertised offer that promised up to 100 per cent cashback and other free electronic devices on the purchase of a TV.

On Wednesday, the Uttarakhand State Consumer Commission ruled in favour of LG Electronics in the complaint filed by a Roorkee resident. The complainant, Ratan Singh Negi, alleged that an advertisement promised a free Bluetooth speaker, an Airtel digital set-top box, and up to 100% cashback with the purchase of a television.

He bought the TV for Rs 62,000 on October 16, 2017, during the Diwali offer, but did not receive the promised items. Although the Haridwar District Consumer Commission initially supported Negi’s case in May 2019, LG argued that his TV model was not part of the advertised offer.

LG challenged the district commission’s decision in the state consumer commission, which overturned the ruling and dismissed Ratan Singh Negi’s complaint. The state commission found no deficiency in services, noting that Negi had purchased a different television model than the one advertised.

It stated that Negi did not provide sufficient documentary evidence to demonstrate that the promotional offer applied to his model. The commission emphasized, “The burden was upon the complainant to prove that the television model purchased by him was part of the advertisement, but he has failed to discharge that burden.”
