Mumbai: The Bombay High Court on Friday (September 27) quashed an order passed by a special court granting permission to former media executive Indrani Mukerjea, accused of killing her daughter Sheena Bora in 2012, to travel abroad.

Justice Shyam Chandak set aside the special court order while hearing a plea filed by the Central Bureau of Investigation (CBI) challenging the said order.

Special court allowed Indrani Mukerjea’s plea to travel abroad on July 19

The special court had on July 19 allowed a plea filed by Indrani Mukerjea to travel to Spain and the United Kingdom for ten days between the intermittent period over the next three months with certain conditions.

The special court had allowed Indrani Mukerjea’s plea with the condition to furnish a security deposit of Rs 2 lakh and to attend the office of the Indian Embassy or its allied diplomatic mission offices at Spain and United Kingdom at least once during her visit and obtain an attendance certificate.

CBI moved High Court against special court order

The CBI had moved the High Court on the grounds that Indrani Mukerjea is a prime accused in the murder case of her daughter and the trial of the case is ongoing and she was facing trial for a serious offence and hence, it would not be appropriate to let her leave the country at this stage. It had further said that there was a possibility of her fleeing the country if allowed to travel abroad.

Order of special court not reasonable, and hence unsustainable: High Court

“The petition is allowed. The impugned order is set aside,” the High Court said, news agency PTI reported.

The High Court, while clarifying that it has not made any remark on the merits of the case and has only noted that the order of the special court was not reasonable, and hence it was unsustainable, said that if Indrani Mukerjea wants to carry out the desired work from India then the statutory authority concern shall help her.

Indrani Mukerjea was arrested in the murder case of her daughter in August 2015 and she is currently out on bail. She is being tried for the alleged murder of her daughter before a trial court. Peter Mukerjea, former media baron and Indrani Mukerjea’s former husband, was also arrested for in the case for allegedly being a part of the conspiracy linked to the murder.

All accused in the Sheena Boa murder case, which has been investigated by the CBI, are currently out on bail.
