The trial court had on November 19 allowed a Hindu side suit seeking survey of Shahi Jama Masjid at Chandausi and ordered for the survey of the mosque, saying it is probable that the report of the survey will facilitate the court in deciding the matter.

The Muslim side later moved the Supreme Court against the trial court order and the top court directed the trial court to halt proceedings in the case and not to pass any order in the plea related to survey of the mosque and not to open any survey report till the matter is heard by the appellate court. The Muslim side later moved the Allahabad High Court, which today (January 8) stayed proceedings before the Sambhal trial court till February 25.

Shahi Jama Masjid was built by destroying a Hindu temple, Hindu side has claimed

The Hindu side in its suit before the trial court has claimed that Shahi Jama Masjid was built by destroying a Hindu temple on the same location where Harihar temple earlier stood.

Have submitted a copy of top court order before trial court: Muslim side

Shakil Ahmad Wari, advocate who represented the Muslim side before the trial court, told reporters on Wednesday that the Muslim side has filed a copy of the Supreme Court order which directed all the lower courts in the country not to entertain any new suits seeking surveys of any place of worship till the further order and the court has fixed March 5 as the next date of hearing.

“The Supreme Court has directed all the lower courts not to entertain new suits seeking surveys of any place of worship until further orders. We have filed a copy of the said order in the court, which fixed March 5 as the next date of hearing,” news agency PTI quoted Wari as saying.

We will prove in the court that it was not a Harihar temple, but Jama Masjid: Muslim side lawyer

Wari, when asked about the Hindu side’s claim that the mosque was built over an ancient Hindu temple, said, “We will prove in the court that it was not a Harihar temple, but Jama Masjid. We have all the evidence.”

Gopal Sharma, the lawyer who represented the Hindu side, claimed that the other side has not filed any reply and said, “We filed an application with the court demanding their opportunity to reply should now end. Now the matter will be heard on March 5.”
