New Delhi: The Supreme Court on Tuesday noted that the trial in the rape and murder of on-duty woman doctor at RG Kar Medical College and Hospital is likely to conclude in a month after it was informed that 43 out of 52 prosecution witnesses in the case have been examined so far and the trial in the case is likely to be concluded soon.

Solicitor General Tushar Mehta, who appeared for the CBI, placed before a bench comprising Chief Justice of India (CJI) Sanjiv Khanna and Justice Sanjay Kumar the status report of the investigation and progress of the case before the trial court.

Mehta told the bench that there are two categories of accused in the case – the rape and murder case and those responsible for the destruction of evidence and the corruption aspect in the case.

Apex Court was hearing a suo motu cognisance

The bench was hearing a suo motu cognisance it had taken of the rape and murder of the woman doctor at RG Kar Medical College and Hospital on August 9.

The bench was informed that the trial is being conducted on day-to-day basis from Monday to Thursday at a local court in Kolkata and 43 witnesses out of 52 prosecution witnesses in the case have been examined and the trial is likely to be concluded in a month.

“Status report has been submitted by the CBI. Statement of 43 witnesses have been recorded. There are a total of 52 witnesses and the trial is likely to conclude in a month,” the bench noted.

Sealdah trial court had on November 4 framed charges against Sanjay Roy

The Sealdah court had framed charges against prime accused Sanjay Roy, who has been booked in the case under section 64 of the Bharatiya Nyay Sanhita (BNS) Section 66 (which pertains to punishment for causing death or resulting in a persistent vegetative state) and 103 (punishment for murder), on November 4. He was arrested in the case the following day of the incident on August 10 by the Kolkata Police.

CBI earlier filed a chargesheet against Sanjay Roy

The CBI, which took over the investigation of the on-duty woman doctor’s rape and murder case from the Kolkata Police on the orders of the Calcutta High Court, has, in its chargesheet, relied on various oral and documentary evidence and forensic and scientific reports to establish that prime accused Roy was the sole perpetrator of rape and murder of the woman doctor at the RG Kar Medical College and Hospital’s seminar room on August 9.
