Pune Porsche accident: SC denies pre-arrest bail to father of juvenile’s minor friend

New Delhi: The Supreme Court on Tuesday (November 5) refused to interfere with a Bombay High Court order denying anticipatory bail to the father of a minor who was allegedly present with another minor during the Porsche car accident killing two IT professionals on May 19 in Pune.

A bench comprising Justice Sudhanshu Dhulia and Justice Ahsanuddin Amanullah refused to grant relief to Arunkumar Devnath Singh, the father of the juvenile driver’s minor friend.

“You may have a case in the trial. We are not inclined,” the bench said.

Bombay High Court on October 23 rejected Singh’s anticipatory bail plea

The high court on October 23 rejected Singh’s anticipatory bail plea, noting that prima facie ingredients of an offence were made out against him.

The prosecution had told the High Court that absconding of Singh, who is accused of replacing the blood samples of his minor son in connivance with the doctors at the government-run Sassoon Hospital, created an impediment to the probe.

It has been alleged that Singh’s juvenile son was allegedly present in the rear seat of the Porsche car, which was allegedly being driven by another juvenile and both juveniles were purportedly drunk when the luxury car fatally hit two motorbike-borne IT professionals, a man and a woman aged 24 years, on May 19 at Kalyani Nagar junction at around 3.15 am.

The police has also alleged that bribe was paid by the parents of the juvenile driver to swap his blood samples with those of his mother.

JJB granted bail to juvenile few hours after the accident with certain conditions, including writing a 300-word essay

The Juvenile Justice Board (JJB) granted bail to the juvenile driver few hours after the accident on May 19 with certain conditions. The conditions by the JJB included a visit to the Regional Transport Office and study traffic rules there and to submit a presentation to the JBB within 15 days and to write a 300-word essay on the topic of road accidents and their solutions.

JJB later cancelled the juvenile’s bail

The JJB, however, later cancelled the bail granted to the juvenile after an application was moved by the Pune Police seeking cancellation of the bail of the juvenile following the outcry over grant of bail to him. The JJB later sent him to an observation home located in Pune where he was lodged till the Bombay High Court on June 25 ordered for his release from the observation home.

Juvenile’s grandfather and parents were also arrested by the Pune Police in connection with the accident case.
