New Delhi: The Delhi High Court on Friday (February 7) reserved its order on a plea by Bramulla Lok Sabha Member of Parliament (MP) Sheikh Abdul Rashid, popularly known as Engineer Rashid, seeking custody parole to attend the ongoing Parliament session.

Justice Vikas Mahajan reserved the order after hearing submissions made by the counsels representing Rashid and the National Investigation Agency (NIA).

Rashid moved a plea seeking interim bail to attend the Parliament session and custody parole in the alternative.

“Judgement reserved,” Justice Mahan said.

NIA opposed custody parole for Rashid to attend Parliament

The counsel representing the NIA has opposed Rashid’s plea seeking custody parole to attend the Parliament session, saying he had no vested right to attend Parliament. The NIA said that he has not shown any “specific purpose” and also raised security issues in letting the Baramulla MP, who is currently lodged in judicial custody in Tihar Jail in a terror funding case, attend the ongoing Parliament session.

The counsel representing Rashid has argued that his parliamentary constituency was not being represented in Parliament and he ought to be allowed to attend the Parliament session.

“I represent the largest constituency of Jammu and Kashmir. Don’t prevent the representation when the process of inclusion has started… Don’t stifle the voice of the constituency, Rashid’s counsel argued before the High Court.

Rashid has also sought quick disposal of his bail plea pending before trial court

Rashid has also filed a petition before the High Court seeking a direction for quick disposal of his regular bail plea in the terror funding case pending before a trial court.

Rashid’s counsel has argued before the High Court that he had been left in limbo and without remedy after the NIA court hearing his regular bail plea sent the matter back on the ground that it was not a special MP/MLA court to hear the matter since he was now a lawmaker.
