New Delhi: The Delhi High Court on Friday (September 13) granted interim bail till January 30 to four jailed co-owners of a coaching centre basement in Old Rajendra Nagar where three students lost their lives after drowning on July 27.

Justice Dinesh Kumar Sharma, while pronouncing the verdict on the bail pleas of the four co-owners of the coaching centre basement, said that the conduct of the co-owners is “unpardonable” and an “act of greed” and said that the relief granted to them is subject to the co-owners depositing Rs 5 crore with the Red Cross Society.

The High Court has made a request to the Delhi Lieutenant Governor to constitute a committee under a retired judge of the high court to ensure that no coaching centre is permitted to run without permission. It further said that the authorities in the city should also carve out a place for coaching centres in the national capital.

Co-owners of coaching centre basement moved High Court against trial court order denying them bail

The co-owners of the coaching centre basement – Parvinder Singh, Tajinder Singh, Harvinder Singh and Sarbjit Singh – had moved the High Court challenging a trial court order denying them bail saying that the CBI investigation was at an initial stage and specific role of the co-owners had to be ascertained.

The co-owners of the basement of the coaching centre – RAU’s IAS Study Circle – argued before the High Court that they cannot be held liable for the deaths of three students and urged the High Court to grant them bail in the case being investigated under the Bharatiya Nyaya Sanhita (BNS), including section 105 (culpable homicide not amounting to murder).

The CBI opposed the bail pleas of the co-owners of the coaching centre basement, submitting that the probe into the case was at initial stages and relief should not be granted to them until the independent witnesses in the case are examined as they may be influenced.

Three students drowned in the basement of the coaching centre on July 27

Three students Shreya Yadav, Tanya Soni, and Nevin Dalwin – drowned in the basement of the coaching centre in Old Rajendra Nagar after the basement was flooded following rain in the evening of July 27.

The High Court transferred the investigation of the case from the Delhi Police to the CBI.
