RG Kar rape-murder case: Calcutta HC directs victim’s parents to approach trial court for permission to visit crime scene

Kolkata: The Calcutta High Court on Thursday (June 26) directed the parents of the RG Kar Medical College and Hospital doctor who was raped and murdered at the hospital on August 9 last year to approach the trial court with the application seeking permission to visit the crime scene.

Justice Tirthankar Ghosh noted that further investigation into the case is being carried out by the Central Bureau of Investigation (CBI) and the ACJM, Sealdah, is in seisin of the issues, hence no order can be passed without keeping the magistrate informed.

Justice Ghosh directed the magistrate to dispose of the application, if filed by the victim’s parent, within 48 hours.

The parents of the victim requested permission to inspect the site of the crime, except the seminar room of the RG Kar Medical College and Hospital, where the body of their daughter was found on August 9 last year.

The counsel representing the CBI submitted that since since the CRPF is in charge of security at the RG Kar Medical College and Hospital, such permission is warranted from a court of law.

The counsel representing the State government opposed the plea of the parents of the victim, submitting that if the parents of the victim intends to seek reinvestigation of the case, it should be followed with a prayer for setting aside the whole investigation from the beginning and should make it clear whether they seek further investigation or a fresh probe into the case, news agency PTI reported.

The 31-year-old trainee woman doctor was raped and murdered in hospital’s seminar room on August 9 last year when she had gone there to sleep during a break. Her body was later found with severe injuries in the seminar room.

The case was initially being investigated by the Kolkata Police and the High Court later transferred the investigation of the case to the CBI following nationwide outrage and protests against the heinous crime.

A Sealdah trial court convicted accused Sanjay Roy for the crime and awarded him life imprisonment until death. The trial court rejected the prayer of the CBI seeking death penalty for Roy, stating that the case did not meet the stringent criteria for being classified as “rarest of the rare” case.
