Nainital: In a troubling incident highlighting the dangers of misinformation and online harassment, advocate Kartikay Hari Gupta, representing Husan Begam, wife of Mohd Usman, has filed a police complaint after receiving life threats and facing online impersonation.

The threats reportedly escalated after Gupta took up the case challenging a demolition notice issued to Begam’s home following her husband’s arrest in a rape case.

Fake social media account & targeted harassment

Gupta, who does not use social media, was alerted by friends about a fake Facebook account falsely attributing vulgar and communal content to him. The fabricated posts aimed to damage his professional reputation and stir communal tensions. Additionally, an old photograph of Gupta with former Chief Minister Harish Rawat was circulated online, misleading people into believing he had political affiliations.

Concerned about the impact of digital misinformation, Gupta warned that unchecked false narratives could undermine trust in the judiciary and threaten the safety of legal professionals. He emphasized that such targeted harassment not only affects individuals but also disrupts communal harmony and erodes confidence in legal institutions.

Legal experts and civil society groups have echoed Gupta’s concerns, calling for stronger cyber laws and swift action against digital impersonation. The Nainital police have confirmed receiving Gupta’s complaint and assured that an investigation is underway to verify the allegations before initiating legal proceedings.

Communal tensions & legal representation debate

Usman’s arrest in the rape case of a 12-year-old minor has already triggered protests and communal unrest in Nainital. The Nainital Bar Association recently passed a resolution urging its members not to represent Usman, warning of disciplinary action against those who take up his defense. However, the High Court intervened, stating that every accused is entitled to legal representation, questioning the bar’s stance.
