Delhi govt withdraws plea from SC by previous AAP govt over Ayushman implementation

New Delhi: The supreme Court on Friday (February 28) allowed the Bharatiya Janata Party (BJP)-led Delhi government to withdraw a plea earlier filed by the Aam Aadmi Party (AAP)-led city government over implementation of the PM-Ayushman Bharat Health Infrastructure Mission (PM-ABHIM) scheme in Delhi.

The Delhi government counsel told a bench comprising Justice BR Gavai and Justice PK Mishra that the city government was going ahead with the implementation of the PM-ABHIM scheme in the national capital and sought the permission of the court to withdraw its plea against the Delhi High Court order.

“We are going ahead with the implementation of the scheme so, therefore, now we want to withdraw this SLP (special leave petition),” the counsel representing the Delhi government told the bench.

The apex court bench allowed the Delhi government counsel to withdraw its plea.

Apex Court earlier stayed High Court direction

The top court earlier had on January 17 stayed the High Court direction asking the Delhi government to sign a memorandum of understanding (MoU) with the Union health ministry by January 5 to implement the said scheme in the national capital. It had also issued notices to the Centre and others seeking their response on the plea filed by the AAP-led Delhi government against the High Court order.

The BJP won the recently-held Delhi assembly elections.

What did the Delhi government earlier submit before the apex court?

The AAP-led Delhi government questioned the order of the High Court, asking how can the High Court force the Delhi government to sign an MoU with the Centre and had argued that by doing so, the High Court had redefined powers regarding health.

Seven BJP MPs earlier withdrew their plea from High Court over implementation of scheme

Earlier, seven BJP MPs from the national capital withdrew from the Delhi High Court their plea seeking implementation of the Ayushman Bharat Pradhan Mantri Jan Arogya Yojana in the national capital, submitting that the BJP won the assembly elections in Delhi and it promised to implement the said scheme in its first cabinet meeting.
