MCOCA case: Delhi court to pass order on AAP MLA Naresh Balyan’s bail plea on Jan 15

New Delhi: A city court on Thursday (January 9) reserved its orders on a bail plea filed by Aam Aadmi Party (AAP) MLA Naresh Balyan in a case registered under the stringent Maharashtra Control of Organised Crime Act (MCOCA) and will pass the orders on January 15.

Special judge Kaveri Baweja reserved verdict on Balyan’s bail plea after hearing arguments from Baliyan and prosecution.

The court on Thursday also extended the judicial custody of Balyan in the case registered under MCOCA till February 1 after he was produced before the court on the expiry of his judicial remand earlier granted by the court.

Prosecution opposed Balyan’s bail plea

The prosecution has opposed Balyan’s bail plea and has urged the court to dismiss his bail plea, alleging that he was a facilitator in the organised crime syndicate and that Balyan, along with his absconding associates, were involved in the commission of organised crime, including extortion from businessmen.

The prosecution further submitted that if bail was granted to him in the case, he could influence witnesses, destroy evidence and hamper the ongoing investigation.

“They (witnesses) have confessed that accused Naresh Balyan is facilitator/conspirator in the organised crime syndicate of Kapil Sangwan and he has provided money to one of member of syndicate after commission of crime for expenses during evading his arrest,” special public prosecutor Akhand Pratap Singh told the court while opposing Balyan’s plea seeking grant of bail.

The court has fixed for January 22 for hearing arguments on the chargesheet in the case registered under the MCOCA, news agency PTI reported.

Balyan was arrested in MCOCA case on December 4

Balyan was arrested in the case registered under the MCOCA on December 4 while he was in police custody in an alleged extortion case. He was granted bail in the extortion case on December 4.
