New Delhi: The Supreme Court recently stayed the execution of death penalty confirmed by the Bombay High Court to a man for killing his mother and allegedly eating some of her body parts.

A bench comprising Justice Surya Kant, Justice Pankaj Mithal and Justice Ujjal Bhuyan issued notice on an appeal filed by convict Sunil Rama Kuchkoravi and sought the records of the trial court and the High Court.

Meanwhile, execution of death sentence shall remain stayed: Apex Court

“Issue notice, returnable on 14.04.2025. Meanwhile, execution of the death sentence shall remain stayed. The records of the Trial Court as well as the High Court along with translated version and soft copies of the same be requisitioned,” the Supreme Court bench said while staying the execution of death sentence.

A High Court bench comprising Justice Revati Mohite Dere and Justice Prithviraj Chavan, while confirming the death sentence awarded to Kuchkoravi by a Kolhapur trial court for brutally murdering his mother, said that the act was an extremely barbaric, inhuman, heinous as well as grotesque murder of a hapless, helpless and fragile old mother by her son and the act of the convict was quite close to cannibalism and his act had indeed shocked the conscious of the society.

Showing mercy or leniency to such a person would be misplacing the concept of mercy: High Court

“Under the circumstances, showing mercy or leniency to such a person, would be misplacing the concept of mercy. That apart, showing leniency would be a mockery on the criminal justice system. Therefore, death penalty imposed by the trial Court, needs to be confirmed and accordingly stands confirmed,” the High Court said.

The High Court, while confirming the death sentence, further said that life imprisonment to the convict would be completely futile as the sentencing aim of reformation is completely unachievable and he would be a continuing threat to the society even after completion of his sentence of life, if awarded.
