New Delhi: A city court on Thursday (December 5) sent Aam Aadmi Party (AAP) MLA Naresh Balyan to a day’s judicial custody in a case related to an alleged organised crimes in which he was arrested yesterday by the Delhi Police.

The special court, while sending Balyan to a day’s judicial custody, noted that the arguments, which remained inconclusive on Thursday, on the application of the Delhi Police seeking his 10-day police custody in the case registered under the stringent Maharashtra Control of Organised Crime Act (MCOCA) would require more time.

Balyan was arrested in organised crimes case on Wednesday

Balyan was arrested by the Delhi Police in the case registered under the MCOCA on December 4 while he was in police custody in an alleged extortion case. He was granted bail yesterday in the alleged extortion case by a court, which dismissed the submission of the Delhi Police to send him in judicial custody.

Another court earlier in the day dismissed police’s plea seeking 10-day custody of Balyan

Balyan, who is an AAP MLA from Delhi’s Uttam Nagar Assembly constituency, was on Thursday produced before a court seeking 10-day custody of Balyan and transfer of the case to a court designated to try MPs and MLAs. The court, however, dismissed the plea of the Delhi Police seeking 10-day custody of Balyan. It granted the police liberty to the investigating officer (IO) of the case to “move an appropriate application before an appropriate court”.

The Delhi Police on Wednesday had moved an application before the court to arrest Balyan in the alleged orgamised crimes case lodged MCOCA, however, the court dismissed the plea, calling the plea by the police “not maintainable” and it had said that “whichever agency wants can arrest him (Balyan) as per the law”. The court had also rejected the submission of the Delhi Police to send Balyan in judicial custody and granted him bail in the alleged extortion case. The court had also clarified that Balyan was arrested on Wednesday in the MCOCA case while he was in police custody.
