New Delhi: A city court on Wednesday (November 20) posted for tomorrow the order on regular bail plea of Member of Parliament (MP) from Baramulla Sheikh Abdul Rashid, popularly known as Engineer Rashid in an alleged terror funding case.

Additional Sessions Judge Chander Jit Singh also posted for tomorrow whether the case against Rashid be transferred to the designated MP/MLA court, meant to try lawmakers, now that he is a lawmaker.

Rashid won from Baramulla Lok Sabha constituency

Rashid contested the general elections from the Baramulla Lok Sabha seat in Jammu and Kashmir from Tihar Jail and defeated his nearest rival and Jammu and Kashmir Chief Minister Omar Abdullah.

Case could go to a special court meant to try lawmakers, judge earlier noted

The judge had earlier noted that the alleged terror funding case could go to a special court meant to try lawmakers, as Rashid, who is currently lodged in judicial custody in Tihar Jail in the case, is an MP now. The judge, while reserving the order on his bail plea, had said that he would first consider the issue of jurisdiction and whether or not to transfer the case to a special court.

Court earlier granted interim bail to Rashid

The court had earlier granted interim bail to Rashid from the period from September 10 to October 2 in the alleged terror funding case to enable him to campaign in the recently-concluded assembly elections in Jammu and Kashmir.

Rashid surrendered before Tihar Jail authorities on October 28

Rashid’s interim bail was later extended on the ground of health condition of his father and the court had directed him to surrender before the before the Tihar Jail authorities by October 28. He surrendered before the Tihar Jail authorities on October 28.

Rashid, who is the chief of the Awami Ittihaad Party, has been lodged in judicial custody in Delhi’s Tihar Jail in the alleged terror funding case under the Unlawful Activities Prevention Act (UAPA) since 2019 after he was charged by the National Investigation Agency (NIA) under the provisions of UAPA in the said case.
