New Delhi: The Supreme Court on Monday (September 30) expressed its dissatisfaction with the tardy progress in installation of CCTV camera, construction of toilets and separate resting rooms by the West Bengal government.

Ongoing work would be completed by October 15, West Bengal counsel told apex court

The counsel representing the West Bengal government told a bench comprising Chief Justice of India (CJI) DY Chandrachud and Justices JB Pardiwala and Manoj Misra that work is in progress and the ongoing work would be completed by October 15.

The top court was hearing suo motu cognisance of the rape and murder of a 31-year-old trainee doctor at the seminar hall of the RG Kar Medical College and Hospital on August 9.

Apex court perused status report filed by CBI

The bench also perused the status report into the investigation carried out by the Central Bureau of Investigation (CBI) in the rape and murder case of a woman doctor of RG Kar Medical College and Hospital on August 9 and alleged financial irregularities at the institution and noted that substantial leads have come up in the CBI investigation and said that whether there is relationship between the two is a matter of investigation by the CBI.

The counsel representing the doctors told the bench that seven persons from RG Kar Medical College and Hospital, who are investigated by the CBI, are still in employments and sought their suspension temporarily till a decision is taken by the state government, submitting that how can the doctors work safely when they are still in position of power.

The bench also asked Solicitor General Tushar Mehta, who appeared for CBI, who are the people who are under probe and still employed in the RG Kar Medical College and Hospital against whom financial irregularities are alleged and asked the agency to share the information with the state government for appropriate action.

Apex court directed SG to submit a report on progress of NTF

The top court also directed Mehta to submit a report on progress of National Task Force and posted the further hearing into the matter to October 14.

Another lawyer submitted before the court that the inter-state nexus needs to be identified and probed, however, CJI Chandrachud said, “We are looking at the incident and the financial irregularity. If we expand across other hospitals, then CBI will face something impossible. We will see what further needs to be done after RG Kar Medical College and Hospital case” and asked SG Mehta to apprise the court what it needs to be broadened.

At the start of the hearing, the attention of the bench was drawn towards the repeated clips in social media disclosing the name and photos of the victim and the bench said that it has already passed an order in this regard and said that its earlier order that no intermediary is allowed to publish the name and photo of the victim applies to all intermediaries and it was for the law enforcement agencies to implement the said order.

The counsel representing the West Bengal government told the top court that resident doctors are not performing inpatient department and outpatient department work. The submission, however, was opposed by the counsel representing the resident doctors, saying that the resident doctors are performing all essential and emergency services.
